Action by plaintiff to recover $300. On or about April 24, 1965, plaintiff and defendant entered into a contract wherein and whereby plaintiff agreed to purchase seller’s Job No. 51, Map of Dix Hills Village, Section 3. The purchase price was $28,540. The transaction contemplated the construction of a dwelling on the site by defendant.
