FOURT, J.

This is an appeal from a judgment of conviction of possessing marijuana.

In an information filed in Los Angeles on December 7,1965, defendant was charged with possessing marijuana on November 18, 1965. Defendant pleaded not guilty and in a trial with a jury was found guilty as charged. Probation and a motion for a new trial were denied. Defendant was sentenced to the state prison.
