Appellate Division of the Supreme Court of the State of New York April 18, 1967 (Bovino v. Scott)

Determination of the Fire Commissioner modified, on the facts and in the exercise of discretion, by reducing the punishment imposed from dismissal to suspension for a period of six months. As so modified, the determination is affirmed, without costs and without disbursements. The Commissioner’s finding that petitioner was guilty of the charges herein is supported by substantial evidence.
