This is an appeal from an order of the court sentencing the defendant after a violation of probation.

On April 28, 1965, Marcel Whittaker (hereafter referred to as the appellant) was indicted for aggravated battery in violation of chapter 38, section 12-4 of Illinois Revised Statutes 1963.
