This is an article 78 proceeding to review a determination by the Commissioner of the Nassau County Police Department dismissing petitioner from the police department.

Complainant, a 21-year-old woman, was driving along a lonely road in petitioner’s area of patrol at 1:15 in the morning when she was stopped for speeding by a Nassau County police officer.
