On November 30, 1956, defendant’s wife was fatally wounded with a shotgun. Defendant was taken into *377custody immediately after the shooting and was subsequently charged with murder in the first degree in connection with the death of his wife. He was tried, convicted, and the conviction affirmed on appeal. See Reizenstein v. State, 165 Neb. 865, 87 N. W. 2d 560, and 166 Neb.
