This case is before the Court on cross motions for a summary judgment of plaintiff’s declaratory judgment action and on the motion by the District of Columbia to dismiss the third-party complaint filed against it. Plaintiff is *1301the lessor, defendant the lessee, of certain premises destroyed in the April, 1968, riots.
