Appeal from an order of the Surrogate’s Court of Cortland County, entered October 30, 1969, which denied a motion to vacate a decree granting respondent letters of administration. Charles Leila and appellant were married on February 5, 1960. He died in an airplane crash on July 4, 1969. During their marriage they separated and reconciled five times.
