The opinion of the district court, 332 F.Supp. 304 (E.D.La.1971) fully and correctly sets forth the facts of this case and provides sound reasons for the results reached. We summarize the facts here and comment further only to explain our affirmance. The district court did leave unanswered the question why it dismissed the action as to one of the parties.
