OPINION and ORDER

This cause came to be heard upon the motion of the defendant for dismissal of the complaint for lack of jurisdiction over the subject matter on the grounds that the plaintiffs’ claim constitutes an unfair labor practice and, as such, subject to the exclusive jurisdiction of the National Labor Relations Board.
