Plaintiff, Isaiah Tilmon, a cabdriver, was injured in an automobile accident involving another vehicle owned and operated by defendant’s decedent, Matthew Moore.

Plaintiff sued defendant’s decedent for bodily injuries. Plaintiff received workmen’s compensation benefits pursuant to his employment as a cabdriver in the amount of $716.00.
