Alvin J. Breaux was tried and convicted in the Criminal Court of Fulton County on an accusation charging him with violating Code Ann. § *50726-2610 (b) (Ga. L. 1968, pp. 1249, 1316). Prior to the trial the defendant attacked the constitutionality of this statute. The trial court held that the statute was constitutional.
