BARRETT, Circuit Judge.

Johnny Ramirez (Ramirez) appeals a jury verdict of guilty to charges of possession with intent to distribute and distribution of heroin in violation of 21 U.S. C.A. § 841(a)(1).

Ramirez was indicted on February 1, 1974 for drug charges which occurred on October 26, 1973.
