This is an appeal from a judgment and sentence of the Court of Common Pleas, Franklin County, Ohio. Appellant (hereinafter called defendant) was charged with aggravated murder,; resulting from the shooting death of his nephew, Ronald R. Robinson (hereinafter called the deceased), June 29, 1974. The case was tried .to a jury January 27,1975.
