This is an appeal by the state from an order of the trial court dismissing an information which charged appellee with perjury.

In its material parts the information alleged that appellee “did unlawfully and willfully swear or affirm falsely before said [the Seminole Spring Term 1974] Grand Jury, inquiring in and for the body of the County of Seminole, in regards to a material fact
