MEMORANDUM OPINION
MARSHALL, District Judge.
Plaintiff, United States of America, brought this action to recover on a fire insurance policy on behalf of the Small Business Administration (hereinafter “SBA”), the assignee of a policy issued by the defendant insurer. Jurisdiction is based on 28 U.S.C. § 1345.
