This action is before the Court on cross-motions for summary judgment. Plaintiff, Kellen Churchwell, is a registered nurse who has worked fourteen years in the medical profession. On July 7, 1974, Churchwell received a career-conditional appointment to the position of nurse in the Public Health Service Hospital in Sisseton, South Dakota.
