Giannotta filed civil suit in Wayne County Circuit Court on November 18, 1975, challenging the authority of the Governor under Article 6, § 23 of the Michigan Constitution, as amended, to fill vacancies in the office of Justice of the Supreme Court by appointment, or the right of any Justice so appointed to remain in office.
