Petitioner Willie Massey and two of his brothers, Thomas and Billy Massey, went on trial in New York County on July 26, 1973 for the armed robbery and murder of a York liquor store owner earlier that month. After the prosecution had put up ten witnesses, Billy Massey entered pleas of guilty to both crimes during the second day of trial.
