Floyd J. DeHaven, plaintiff, brought this assumpsit action *451to recover from Selected Risks Insurance Company, defendant, the legal expense incurred by plaintiff in defending a trespass action against which defendant allegedly was obligated to defend him under the terms of a policy of garage liability insurance issued by defendant to plaintiff.
