On the first occasion that this suit was before us we reversed the trial court and remanded to allow plaintiffs to file an amended complaint against both defendants or to take such other steps as might be appropriate in order to properly raise for decision by the trial court the question whether Dale may be named by plaintiffs as a party plaintiff or defendant.
