This action for injunctive and ancillary relief is brought by the Securities and Exchange Commission (SEC) pursuant to § 20(b) of the Securities Act, 15 U.S.C. § 77t(b) and § 21(d) and (e) of the Exchange Act, as amended, 15 U.S.C. § 78u (d) and (e), against American Realty Trust (ART) and Thomas Broyhill (Broyhill).
