On July 13, 1977, defendant Roger Du-tremble was indicted in the Superior Court, York County, on one count of criminal homicide in the second degree (17 — A M.R. S.A. § 202 (Supp.1976)).

Following a jury trial, he was convicted of criminal homicide in the fourth degree with a dangerous weapon. (17-A M.R.S.A. § 204 (Supp. 1976)).
