JAMES HUNTER, III, Circuit Judge:

This appeal arises from a defamation suit brought by Samuel R. Dickey against CBS Inc. (CBS) for false statements

about Dickey made by then Congressman Lawrence G. Williams, and broadcast by CBS’s Philadelphia affiliate, WCAU-TV (Channel 10). Sitting without a jury, the trial court held in favor of CBS. 441 F.Supp. 1133 (1977).
