The diversity action giving rise to this appeal and cross-appeal was tried by the court without a jury, upon Peterson Industries, Inc.'s (Peterson) complaint sounding in fraud and deceit for damages. Peterson is an Arkansas company engaged in the business of supplying dressed poultry to wholesalers of that product.
