VOLLERS, Judge.

This is a petition for writ of habeas corpus brought pursuant to Article 11.07, V.A. C.C.P.

In 1974 an indictment was returned against petitioner which alleged that on or about the 23rd of August, 1974 petitioner did “knowingly and intentionally by forgery attempt to acquire and obtain possession of a controlled substance from Floyd H.
