OPINION OF THE COURT

Memorandum.

The order of the Appellate Division should be reversed, and the case remitted for a new trial.

Defendant was convicted, on a jury verdict, of criminal sale of a controlled substance in the third degree and of criminal sale of a controlled substance in the sixth degree, arising out of sales to an undercover police officer on February 26 and March 6, 1975.
