ORDER AND MEMORANDUM OPINION

BALLANTINE, District Judge.

This action was brought by plaintiff under 28 U.S.C. § 1343(3) and 42 U.S.C. § 1983, alleging violation of its constitutional rights by the defendants under color of an Ordinance.

Plaintiff seeks a preliminary injunction restraining defendants from enforcing the provisions of the City of Louisville’s Ordinance 69, Series 1977.
