This motion for summary judgment brought by defendant New York Stock Exchange (“NYSE”) arises from an action by plaintiff Victor Verace (“Verace”) to recover the value of securities deposited with defendant Orvis Brothers and Company (“Orvis”) pursuant to a subordinated lending agreement.
