Defendants have moved to dismiss the charges against them because they were indicted 32 days after arrest, in violation of the 30-day time limit imposed by the Speedy Trial Act of 1974, 18 U.S.C. § 3161

et seq.

The question before the court is

whether the dismissal sanction provided in this statute, § 3162(a), applies to these defendants.
