The plaintiff, Pamela Sestito, as administratrix of the estate of Dominick Sestito (hereinafter decedent), brought this action against the city and the town of Croton

(hereinafter town) and Edward H. Fontaine, a policeman employed by the town, to recover damages for her decedent’s death during an alleged public disturbance at which the defendant Fontaine was a patrolling officer.
