I. The Nature of the Case

The matter at issue is a motion to dismiss filed by the parties designated as “State Defendants,” as explained below.

Plaintiffs bring an action, in two counts, to enjoin construction of Crosstown Street, a thirteen-block long, four-lane roadway, 50 feet wide, between Massachusetts Avenue and Columbus Avenue in Roxbury.
