Mr. LeVasseur was indicted on June 22, 1977, for having committed the offense of theft in the first degree, HRS § 708-831(l)(b) by removing two Atlantic Bottlenose dolphins (Kea and Puka) from the University of Hawaii marine labora*21tory at Kewalo Basin, Honolulu, Hawaii and placing them in the ocean off the Waianae coast of Oahu.
