OPINION

PATEL, District Judge.

The trustee in bankruptcy appeals from an order of the bankruptcy judge granting the debtor’s claim of exemption in residential real property. At issue is a recently enacted provision of the California Code of Civil Procedure, section 690.31, which provides a means for a homeowner to exempt property from execution or forced sale.
