The plaintiff, the Partnership of Brown, Payson, Pellicani and Cloutier, was the second lowest bidder on a public lease contract awarded by the defendant, the State’s Department of Manpower Affairs, to Douglas Schmidt, lowest bidder and “intervenor” in the action below.
