HUYETT, District Judge.

The plaintiffs, a magazine and its publisher, negotiated with the defendant American Express to rent the defendant’s cardholder list. The plaintiffs wished to use this list as their circulation list. According to the plaintiffs, the parties orally agreed that the plaintiffs could rent the list for six months.
