— Appeal from a judgment of the County Court of Broome County, rendered July 11, 1978, upon a verdict convicting defendant of the crime of assault in the first degree. On August 17, 1977, defendant, a student at the State University of New York at Binghamton, and his companion, were stopped by a State trooper while hitchhiking on Interstate 81 in Kirkwood, New York.
