A criminal complaint was filed against appellant on January 8, 1976, charging him with theft by deception.1 Appellant was not arrested until September 10, 1976, at which time he was found in Erie County. A preliminary hearing was scheduled for September 16, 1976 but was continued at the request of the Commonwealth.
