This is a habeas corpus action filed by a state court inmate convicted by a jury of second degree murder after being charged with first degree murder and entering a plea of not guilty. Petitioner appealed his conviction to the North Carolina Court of Appeals, where it was affirmed. See 13 N.C.App. 54, 185 S.E.2d 252 (1971).
