This matter comes before the Court pursuant to motions on behalf of PLM Rail Car Services and Margaret Croxen. PLM Rail Car Services (formerly Sioux City Tank Car Corporation, hereinafter referred to as “PLM”) moves for summary judgment dismissing the third-party complaint by defendant North American Car Corporation (hereinafter referred to as “NAC”).
