Appellant, Jeannie Smith, was convicted by jury verdict of conspiring to commit capital murder in violation of Ark. Stat. Ann. § 41-707 (Repl. 1977), and received a sentence of seventeen years in prison.

The charge stemmed from the shooting death of appellant’s husband, Wade K. Smith, which occurred on March 14,1979 in Miller County.
