MEMORANDUM OPINION AND ORDER

HAIGHT, District Judge:

The parties to this suit on a maritime contract cross move for summary judgment. The essential facts are not in dispute. Defendants owned and operated the S/S ASPHALT MERCHANT. On October 24, 1980 the vessel became disabled off the New Jersey coast and required assistance. Plaintiff, as its name suggests, is in the ocean salvage business.
