COMPTON, Justice.
This case concerns a dispute over mining claims. Appellants Harold W. Shope and Loren C. Hite (“plaintiffs”) sued Appellees Harold Sims, Bruce Sims and Joel Sims (“Sims”), alleging that the Sims had staked mining claims where their valid claims were already located.
