This suit is by an ex-employee for recovery of his alleged vested percentage in the employer’s contribution under a Thrift Plan, which percentage was forfeited by the employer and the administrators of the plan because of the ex-employee’s knowing violation of a non-competition provision of the plan. Trial was to a jury.
