This appeal involves problems which arose in connection with a motion for summary judgment in an action on an account.

The relevant proceedings are as follows. Plaintiff Shirk Oil Company filed a petition against defendant Glen Peterman on an open account in the sum of $10,393.66 for oil products sold and delivered to Peterman.
