THIS MATTER comes before the court on the parties’ cross-motions for Summary Judgment.

In 1977, Plaintiff sued the Defendant for assault and battery in state court. The trial, on September 27, 1977, was to the court. The Honorable Hugh H. Arnold entered judgment in favor of Plaintiff for $7,500.00 in compensatory damages.
