Appellant Asterio La Fargue was convicted by a jury of assault with force likely to produce great bodily injury (Pen. Code, § 245, subd. (a))

and sentenced to the upper term of imprisonment of four years. A mistrial was declared on the remaining charges of assault with intent to rape, and false imprisonment (§§ 220, 236) after the jury was unable to reach verdicts.
