OPINION

MOTLEY, Chief Judge.

This is an action pursuant to Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e-5

et seq.,

and 42 U.S.C. § 1981. Plaintiff, Dr. Nimai K. Ghosh (Dr. Ghosh), a native of India, alleges that defendant NYU Medical Center (NYU) discriminated against him with respect to his employment at NYU on the grounds of race, color, religion and national origin. Dr.
