Richard V. Cleary and Thomas J. Cleary (“plaintiffs”) appeal the district court’s grant of summary judgment to John Mitchell, William Sheskey, and James F. Higgins (“defendants”) on plaintiffs’ action to recover damages under § 10(b) of the Securities Exchange Act of 1934, 15 U.S.C. § 78j(b), Securities and Exchange Commission Rule 10b-5,17 C.F.R. § 240.
