This appeal involves a suit by the Board of Trade of the City of Chicago (“Board of Trade”) against the Commodity Futures Trading Commission (“the Commission”) for a declaratory judgment that a rule promulgated by the Commission is void and for a permanent injunction enjoining the Commission from enforcing that rule.
